The Court of Appeal refused an application by Attorney-General Kerry Shine to have Wayne Verdun George returned to jail for three years. However, it granted a strict three-year probation order instead.
George was jailed three times in seven months for child sex offences in 2003.
After his release on partly suspended sentences in Townsville, George went to Bundaberg, where he sexually assaulted a nine-year-old boy.
George was remanded in custody and then pleaded guilty to four counts of indecent treatment of a child under 12, possessing child exploitation material, and failing to comply with reporting conditions.
He was sentenced to two years’ jail.
George was also put on a 12-month intensive correction order as punishment for breaching an eight-month suspended sentence.
