Michael Ross Sweet pleaded guilty to two counts of indecent assault and one count of inciting a child to commit an indecent act. The offences occurred on 2003. 

The offences were all committed in early 2003 against Sweet's niece who was then aged 12. The victim, who lived in Victoria, used to visit Sweet’s family in Adelaide. 

The first offence occurred between 1 December 2002 and 31 January 2003 at the North Adelaide Aquatic Centre. On that occasion Sweet sat next to the victim alongside one of the pools and touched her on the breasts on top of her bathers.

The second offence occurred between the 1 and 3 March 2003 at the Noarlunga Ice Skating Rink. When Sweet and the victim were alone, he grabbed her from behind and placed his hands over her breasts and kissed her on the neck.

The third offence relates to sexually suggestive emails that Sweet sent his niece between 1 March and 16 April 2003. The emails included ones which were erotic and sexually explicit. Sweet told his wife and the matters were reported to the Adolescent Response Line at around about Easter 2003 and then to the police. The police were unable to take any action because the victim did not want, then, to proceed with the matter. Nevertheless, Sweet undertook a 12 month course with the Sexual Offenders Treatment and Assessment Program between June 2003 and June 2004.

In November 2011, the victim went to the police in Victoria where she lived and charges of indecent assault were laid in Mildura.

Judge Barrett suspended Sweet's 2-year imprisonment sentence and subjected him into a $1000 bond to be of good behaviour for 3 years with conditions.
